Personal data refers to any information relating to an identified or identifiable individual, such as name, surname, national ID number, contact information, etc. Your personal data may be processed under the provisions of the Law on the Protection of Personal Data No. 6698 ("KVKK"), the Electronic Communications Law No. 5809, the regulations of the Information Technologies and Communications Authority, and other relevant legislation; our company takes all necessary technical and administrative measures to prevent unlawful processing, unlawful access, and to ensure the protection of your personal data.
Collection, Processing, and Purposes of Processing Personal Data
Pursuant to Article 4 of the KVKK:
Personal data can only be processed in accordance with the procedures and principles set forth in this Law and other laws. The following principles must be observed in the processing of personal data:
- Compliance with the law and principles of honesty.
- Accuracy and, when necessary, up-to-dateness.
- Processing for specific, clear, and legitimate purposes.
- Being relevant, limited, and proportionate to the purposes for which they are processed.
- Retention for the period stipulated in the relevant legislation or required for the purpose for which they are processed.
Your personal data may vary depending on the product, service, or commercial activity provided by Penta Software; it may be collected verbally, in writing, or electronically through offices, websites, social media channels, mobile applications, and similar means, whether automated or non-automated. As long as you benefit from the products and services of Penta Software, your personal data will be processed and updated. Additionally, when you visit our website or participate in training, seminars, or organizations organized by Penta Software, your personal data may be processed.
To Whom and For What Purposes the Processed Personal Data May Be Transferred
Your recorded personal data may be shared with third-party companies, institutions, and organizations for services such as domain registration, license registration, SSL registration, etc.; software producers for services and licenses used in server services, banks or credit card organizations for payment and collection services, third-party email sending companies for email sending services, companies and institutions processing electronic documents such as e-invoices and e-archives for billing and accounting transactions, third-party statistical and analysis companies for measuring user experiences and conducting marketing activities, and legal authorities to the extent necessary.
Your collected personal data may be processed and transferred for purposes such as carrying out the necessary work by our units for you to benefit from the products and services offered by Penta Software, customizing the products and services offered by Penta Software according to your likes, usage habits, and needs, ensuring the legal and commercial security of Penta YazılımSoftwareand those in business relationships with Penta Software, determining and implementing Penta Software's commercial and business strategies, and ensuring the execution of human resources policies, within the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK.
Methods and Legal Reasons for Collecting Personal Data
Your personal data are obtained by Penta Software in any verbal, written, or electronic environment, in line with the purposes mentioned above, to provide the products and services offered by Penta Softwarewithin the determined legal framework, and to fulfill Penta Software's contractual and legal responsibilities accurately and completely. Your personal data collected for this legal reason can also be processed and transferred for the purposes specified in the (1) and (2) numbered clauses of this text, within the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK.
Rights of the Personal Data Owner Listed in Article 11 of the KVKK
As personal data owners, if you submit your requests regarding your rights to Penta Software using the methods set out below, Penta Software will conclude the request as soon as possible and within thirty days at the latest, depending on the nature of the request, free of charge. However, if the transaction incurs an additional cost, Penta Software will charge the fee set out in the tariff determined by the Personal Data Protection Board.
In this context, personal data owners have the right to:
- Learn whether personal data is processed or not,
- Request information if personal data has been processed,
- Learn the purpose of processing personal data and whether they are used in accordance with its purpose,
- Know the third parties to whom personal data are transferred domestically or abroad,
- Request the correction of personal data if it is incomplete or incorrectly processed, and request that the transaction carried out within this scope be notified to the third parties to whom personal data has been transferred,
- Request the deletion or destruction of personal data despite being processed in accordance with the provisions of the Law No. 6698 and other relevant laws, in case the reasons for processing are no longer valid, and request that the transaction carried out within this scope be notified to the third parties to whom personal data has been transferred,
- Object to the occurrence of a result against the person himself/herself by analyzing the processed data exclusively through automated systems,
Have the right to claim compensation for the damage arising from the unlawful processing of personal data. Pursuant to Article 13, paragraph 1 of the Law No. 6698, you can submit your request to exercise your rights mentioned above to Penta Software in writing or by other methods determined by the Personal Data Protection Board. As the Personal Data Protection Board has not determined any methods at this stage, you need to submit your application to Penta Software in writing in accordance with the Law No. 6698.
